1. Introduction

  1. This Policy is being published by Graceworks Information Systems Private Limited., (“Graceworks”) to lay down and inform its policy of management of information collected by it from its users on the online platforms owned and operated by it and specifically for its platform brand Sprinng which is an intermediary software, technology services, logistics services, e-commerce marketplace in healthcare, nutrition, fitness, sports and wellness domain, which is accessible on its website www.sprinng.com and other of its platforms (referred to as the “Website”).
  2. This Policy applies to Nutritionists, their End Users, and casual visitors to its Website who access or use any of the services of Graceworks on such platforms.
  3. The Policy specifies:     
  4. the information that is collected on its Website from its users; and 
  5. the purpose and methods adopted for collection of such information and the protection provided, usage, processing, retention and obliteration of such information.
  6. Users should check this webpage from time to time to review their agreement with this Policy as Graceworks may amend this Policy to incorporate its management policies or to comply with the Indian Law.  
  7. Nutritionists, End Users and Casual visitors should specifically read Section 6, 7 and Section 8 respectively.
  8. Nutritionists and End Users are (collectively referred to as “Users” unless specified otherwise however for the purposes of Section 10 shall also include the casual visitors to the Website).
  9. Terms that are not defined here shall have the same meaning as ascribed to them under the Terms and Conditions at http://www.sprinng.com/terms and conditions. 

2. Commitment

  1. Graceworks is committed to protect privacy of its Users and the information collected by it and provided by Users/ casual visitors and the same will be treated only in accordance with this Policy and the Indian Law.
  2. The use of the Services of Graceworks is subject to the agreement of the Users with respect to the same.
  3. Refer Section 4 below for the information security mechanisms adopted by us.

3. Compliance and Consent of Users:

  1. All the persons/ Users are required to read this Policy and transmit their express consent to this Policy at the details mentioned at Section 14 in order to signify it.
  2. Persons/ Users who are in disagreement with this Policy or howsoever violate this Policy shall terminate usage of the Services and access to the Website with immediate effect.
  3. Graceworks is the author, owner and publisher of the aforesaid Website and its online platforms, including its proprietary brand ‘Sprinng’ and is owner of all intellectual property comprised therein.
  4. All Users shall have the requite authorisation to use the Services of Graceworks and should be legal persons with capacity to contract and give their express consent to this Policy under the Indian Law, in the manner specified above.

4. Confidentiality and Information Security:

  1. Graceworks has implemented standard practices and security procedures and necessary, physical, logistical and storage and contractual protection such as contractual commitments with their employees, third parties and partners in order to effectuate and ensure protection of the information of its Users and storage systems at all times.
  2. This information may be also converted into physical form from time to time and all necessary precautions to protect personal information both online and off-line are taken.
  3. Graceworks’ security practices and procedures in implementation include but are not limited to:
    1. keeping all the data within private cloud,
    2. encrypting the moving data using industry standard practices,
    3. regularly changing production keys and password,
    4. secured, restricted and limited access to all production servers; and
    5. performing regular security updates on our servers and more.

5. Information Collected:

  1. Systems at Graceworks require the Users to voluntarily provide certain information that personally identifies such User or could be used to personally identify them and does collect sensitive personal data relating to a User.
  2. Graceworks asks of the following information while subscribing for the Services from its Users which is to be provided voluntarily:
    1. personal and contact data (name, age, gender, date of birth including your e-mail address and phone number);
    2. demographic data (such as pin code);
    3. data regarding the usage of the Services and profiles of the Users and appointments made by or with the Nutritionists through the use of services of Graceworks;
    4. other information that the Users voluntarily choose to provide to us (such as information shared by you with us through emails or letters).
  3. At all visits to the Website, Graceworks automatically receives the following:
    1. URL of the site from which such a visit is made,
    2. the Internet Protocol (IP) address of each User’s computer, User’s computer operating system and type of web browser the User is using,
    3. email patterns, as well as the name of User’s ISP.
  4. The aforesaid information is used to analyze overall trends to help Graceworks improve its Services. The linkage between User’s IP address and User’s personally identifiable information is not shared with third parties.
  5. Financial Information:

    1. Graceworks may require the User to pay via credit card, wire transfer, debit card or cheque for Services for which subscription amount(s) is payable.  
    2. In this respect all the aforesaid information and like is collected by the payment gateway. Verification of credit and payment procedures, however, are executed solely by the User through the authentication process. User’s credit-card/debit card details are transacted upon secure sites of approved payment gateways, Users should review the policies of the payment gateway before proceeding.

    6. Policy for Nutritionists:

    1. The information provided by the Nutritionists is exclusively owned by Graceworks and is used by it to assist in describing and identifying them as such professionals.
    2. It may use such information for the following commercial purposes and in an aggregated or non- personally identifiable form for the following purposes:
      1. research, statistical analysis and business intelligence purposes:
      2. Publishing such information on the Website.
      3. Contacting Nutritionists for offering new products or services.
      4. Contacting Nutritionists for taking product feedback.
      5. Analyzing software usage patterns for improving product design and utility.
      6. Analyzing anonymized practice information including financial, and inventory information for commercial use.
      7. Graceworks can also sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates.
      8. Graceworks also reserves the right to use information provided by or about the Nutritionists for the aforesaid purposes.

    7. Surveys:

    1. Graceworks does conduct surveys on its Website and other platforms to collect information about usage experience and procuring feedback. These surveys are optional and the responses of the Users are kept anonymous and confidential. 
    2. Graceworks may offer contests to qualifying the Nutritionists and End-Users in which contact and demographic information may be asked for and collected. Such information will be used to improve the Services to meet the needs and preferences of Users. This may include providing access to advertising to the Users about Graceworks Services.

    8. Policy for the End Users:

    1. Non- personally identifiable information, is collected by Graceworks from the End-Users and is exclusively owned by it. 
    2. The information provided by the End-Users during the registration/application and submission procedure that is available to the End-Users on the Website such as personally identifiable information, is used to help the End-Users identify themselves.
    3. Graceworks can also keep records of electronic communications and telephone calls received and made for making engagements with the Nutritionists or administration of Services or any other purpose such as customer support, research and development and for improved listing of Nutritionists.
    4. Graceworks may also use anonymized End-User demographics information and anonymized End-User health information for the following purposes in an aggregated or non-personally identifiable form for the following purposes: 
      1. Analyzing software usage patterns for improving product design and utility;
      2. Analyzing such information for research and development of new technologies;
      3. Using analysis of such information in other commercial product offerings of Graceworks; and
      4. Sharing analysis of such information with third parties for commercial use.
      5. research, statistical analysis and business intelligence purposes.
    5. Graceworks can sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates. In particular, Graceworks reserves with it the right to use anonymized End-User demographics information and anonymized End-User nutrition and health information for the aforesaid purposes.

    9. Policy for the Casual Visitors:

    1. Graceworks does not collect any sensitive personal data or information automatically from any casual visitors of its Website.
    2. If a casual visitor, inadvertently browses any other page of this Website prior to reading this Policy and does not agree with the manner in which such information is set out to be treated here, then merely quitting the browser application should ordinarily clear all temporary cookies installed by Graceworks.
    3. As such all visitors are encouraged to use the “clear cookies” functionality of their browsers to ensure such clearing / deletion, as Graceworks cannot guarantee, predict or provide for the behaviour of the equipment of all the visitors of its Website.

    10. Policy for all Users:

    1. The terms of policy regarding the Nutritionists and the End Users and casual visitors has been specifically mentioned only for clarity, all the other terms of this Policy apply fully on the Nutritionists shall specifically review the treatment of the Policy concerning the End Users. 
    2. The Users understand that Graceworks may use certain information, which has been designated as Sensitive Personal Data or Personal Information under the Indian Law. 
      1. for the purpose of providing the Services to the Users,
      2. for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, for
      3. for sale or transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates.
    3. Graceworks may with respect to the information mentioned at section 5 (iii) share some of the aggregate findings (not the specific data) in anonymized form (i.e., non-personally identifiable) with advertisers, sponsors, investors, strategic partners, and others in order to help grow its business.

    11. Cookie and other Policy:

    1. The Website uses temporary cookies to store certain data (that is not Sensitive Personal Data or information) that is used by Graceworks and its service providers for the technical administration of the Website, research and development, and for User administration. In the course of serving advertisements or optimizing services to its Users.
    2. Graceworks may allow authorized third parties to place or recognize a unique cookie on the User’s browser. The cookies however, do not store any personal information of the User.
    3. Graceworks maintains a strict "No Spam" policy, which means that Graceworks does not intend to sell, rent or otherwise give the User’s e-mail address to a third party without his/her consent. 

    12. Limitation of Liability:

    1. Graceworks does not control or endorse the content and any other element of the Services and, therefore, it specifically disclaims any liability with regard to the services received from the Users shall not be liable for any actions by /or between the Users unless the same is attributable to it for breach of the Terms of Use and this Policy.
    2. It shall not be liable for the security of User’s personal information by third parties outside of its agreement with such parties. 
    3. It shall not be liable for any data loss or theft due to unauthorized access to the User’s electronic devices through which the User avails the Services, Graceworks shall not be held liable for any loss whatsoever incurred by the User.
    4. Graceworks shall not be responsible for any breach of security or for any actions of any third party or events that are beyond the reasonable control of Graceworks including, acts of god, orders of government instrumentalities and law enforcement agencies, breach of security by information trespass such as by hackers, unauthorised access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of internet service or telephone service of the Users etc.

    13. Notice to Users:

    1. Collection, use and disclosure of information which has been designated as Personal Information or Sensitive Personal Data or Information’ under the Indian Law requires User’s express consent. By affirming assent to this Privacy Policy, User provides consent to such use, collection and disclosure as required under the Indian Law.
    2. No administrator at Graceworks will have knowledge of the login passwords of the Users.
    3. Users must log off from the Services online when they are no longer using the same. The Users shall also provide adequate protection to their login details and computer systems from any unauthorised access.
    4. In the event a User becomes aware of an unauthorised usage of his/her account he/she should immediately inform Graceworks of the same.
    5. Graceworks will communicate with the Nutritionists and the End-Users through their e-mail, telephone and notices posted on its website or through other means available through the Services.
    6. The Users can change their contact preferences at any time by logging into their account at the Website and changing the same.
    7. In the event any information is required to be amended such User can contact the following Customer Support and require assistance.
    8. Users may choose to unsubscribe from promotional communications that the User’s receive from Graceworks by clicking the ‘unsubscribe’ link provided at the end of every such promotional communication.
    9. Graceworks will not sell, distribute or lease personal information to third parties unless it has the User’s permission or are required by the Indian Law. Users may request details of personal information which Graceworks hold about the Users under the (Indian) Data Protection Act, 1998.
    10. belongs to another person and to which the user does not have any right to;
    11. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.

    15. Termination of Service:

    1. If a User wishes to cancel his/her account or request that Graceworks no longer use his/her information to provide you services, such User shall contact at the Customer Support.
    2. Graceworks will retain the information for as long as the User account with the Services is active and as needed to provide the Services. Graceworks shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under the Indian Law.
    3. After a period of time, data may be anonymized and aggregated, and then may be held by Graceworks’ us as long as necessary for us to provide our Services effectively, but Graceworks’ use of the anonymized data will be solely for analytic purposes.
